C i t `, of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the applicant; and would be in keeping <br />with tho spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />CONCLOSIOINSv ORDER AND CONDITIONS <br />Based upor one or more of the findings noted above, the Orono <br />City Council hereby grants approval of the above referenced variances to <br />permit the major upgrading of the commercial lakeshore property known as <br />Windward Marine, Inc., based on plans drawn by Rutledge Construction, Job <br />No. J6158, revised date 4/4/88 Sheet 2A subject to the following <br />conditions: <br />1. Prior to issuing a building permit for new construction and/or <br />issuing a demolition permit for the razing of the existing structures <br />the following must be completed by the applicant: <br />A) The execution of an agreement by both applicant and the City <br />of Orono that would set forth a three year phased improvement <br />project for the comprehensive upgrading of the marina property <br />that would extend the effective deadline of the variances noted <br />above for a three year period commencing at this current approval <br />date. <br />B) Approval by the City Engineer of the final drainage and <br />surface run-off plans for the parking areas. <br />C) Site plans to be amended to include a green area south of <br />the crane location on Tanager Lake. <br />2. Payment of two SAC units at $900.00 ($450.00 per unit), to be <br />paid with the building permit for the construction of the comx-Prcial <br />structure. <br />3. The 50' by 90' commercial structure must be provided with an <br />automatic sprinkler system per State Building Code, Appendix E. <br />4. An approi,-iate soil erosion control E rogram shall be maintained <br />throughout the entire project and until permanent erosion control is <br />in effect. <br />5. Applicant shall work with the Hennepin County Highway Deyarts+ent <br />of Transportation to pursue the possitilit of a crosswalk tetween the <br />twe cc;trtrtwrcia 1 1.ortionn of the facility un Tanager Lake and Brown's <br />Pay. <br />Page 4 of 6 <br />
