Zoning File #1285 <br />Page 2 of 2 <br />In review of Section 10.55, Subdivision 11, Subdivision 12, Sections C and <br />D, and Subdivision 13 staff can easily make the following findings: <br />1. The placement of this permanent dock will have no adverse effect <br />on the capacity of the f loodway or increase the flood heights of the <br />Lake Minnetonka Watershed. <br />2. The proposed dock as constructed does not propose a danger <br />to life and adjacent properties. <br />3. The proposed structure certainly appears to be consistent with <br />the intent of the Comprehensive Plan and Flood Plain Management <br />Program for the area. <br />Staff would suggest there are very few appropriate standards for the review <br />of a permanent dock. It is interesting to note that the issue of <br />navigation is not called out. The proposed dock will not inhibit <br />navigation. If the Planning Commission has any other questions or <br />standards they feel appropriate, please feel free to note them at the <br />meeting. As with previous building permit applications for permanent <br />docks, the City requires confirmation from the DNR that a permit <br />application has been processed and approved. The City will not issue a <br />building permit for the new dock until the DNR has completed their permit <br />review. <br />Please review Subdivision 14 that suggests certain conditions that may be <br />attached to these Conditional Use Permits. If the Planning Commission can <br />find an appropriate condition that would relate to the operation and <br />placement of a permanent dock, please advise. Staff would suggest the <br />following conditions for the approval of this Conditional Use Permit: <br />1. Prior to the City issuing a building permit for the permanent <br />dock, the DNR permit must be finalized. <br />2. "he dock structure has been approved per the plans by Minnetonka <br />Porti-ole Drudging entitled dock detail dated 5/5/88 sheet 1 of 1, any <br />expansion or major alteration of this dock is subject to the review of <br />the City of Orono. <br />Additional Comments and Planning Commission Recommendation <br />Planning Commission had no other comments concerning this review and <br />recommended approval based on the staff recommendation noted abcve. The <br />encolosed resolution has been drafted per the approval recommendation. <br />
