proper planning will not be lost, to prevent the destruction <br /> of the marshes and wetlands, and to preserve the status quo <br /> pending adoption of these measures so that the City will not <br /> be impaired in its ability to effectuate the purposes and goals <br /> of these planning efforts. <br /> Since enactment of an amendment will undoubtedly modify <br /> existing regulations concerning filling and excavating, the <br /> granting of various filling and excavating permit applications <br /> during this interim period would be detrimental to the effectuation <br /> of the comprehensive plan and contrary to the purposes of the <br /> zoning enabling act, Minnesota Statutes, �462. 351 et seq. The <br /> Council further finds that it would be unwise, improper and unjust <br /> to allow individual filling and excavating to occur during this <br /> study period to avoid discrimination and unfair advantage to a <br /> few to the detriment of the entire City. Therefore, the Planning <br /> Commission's discretionary authority to grant permits or approve <br /> applications described herein shall not be exercised during the <br /> limited term of this ordinance. <br /> Section 2 . Restrictions on the Granting of Filling and <br /> Excavation Permits and Applications. No filling or excavation <br /> permits, conditional or special use permits, variances or other <br /> authority for additional filling or excavating in the marshes <br /> and wetlands within the City shall be granted for any purpose <br /> which would be inconsistent with the intent of this ordinance. <br /> Section 3. Restricted Area. The entire City of Orono <br /> shall be subject to the restrictions of this ordinance. <br />
