s <br /> 4) Serving all dwellings, buildings or structures <br /> containing a water-activatec� toilet regardless of the <br /> type or duration of use or occupancy. ' <br /> 5) Any dwelling , building or structure having running <br /> water plumbed inside to any sink, lavatory, tub, <br /> shower , or anyother plumbing fixture , but not a toilet , <br /> shall have a conforming grey-water disposal system <br /> including a septic tank and drainfield connected to <br /> such fixture drain (s) . <br /> 5) Any existing dwelling , building , or structure <br /> required by one or more of the above subsections to be <br /> connected to an on-site sewage treatment system, but <br /> which is not so connected as of the effective date of <br /> this ordinance, or which has an existinq system that <br /> does not conform to minimum setbacks or other <br /> requirements of this section, shall have a new <br /> conforming on-site sewage treatment system installed <br /> on or before January 1 , 1988. <br /> 7) All provisions of the On-Site Sewage Treatment Code <br /> shall apply to on-site sewage treatment in the "RS" <br /> District , including without limitation the require- <br /> ment for construction permits, construction <br /> inspection, and regular maintenance inspections, <br /> including payment of the standard annual service <br /> charge. <br /> e) Owner' s Responsibility. It shall be the responsi- <br /> bility of each property owner to demonstrate that the on-site <br /> sanitation device or system in use or existing on his property is in <br /> conformance with all requirements of this Section and Ordinance No . <br /> 210; that the device or system properly treats and/or disposes of the <br /> entire sewage input generated on the property; and that the device or <br /> system is adequately and properly maintained at all times. If <br /> unpermitted non-conforming , mislocated , orfailing devicesor systems <br /> shall be found by the City because of complaint and/or routine <br /> inspection, correction orders shall be issued by the Building Official <br /> or On-Site Manager requiring repair , alteration or replacement in <br /> strict accordance with the requirements of this Section. Failure of <br /> any owner to obey such a lawful order shall be cause of the City to <br /> initiatelegal actionsincluding condemnation of all occupancy of the <br /> property pursuant to Minnesota Statutes 463 . 15 et seq. <br /> 34.373. RS: Garbage Removal and Sanitation. within any "RS" <br /> Seasonal Recreati na�Dist—r ct, each property owner , occupant or user <br /> shall be responsible for packing out and off the islands all garbage , <br /> refuse, rubbish, junk, old machinery, parts or debris created or <br /> brought onto the island by such person, and for removal of all such <br /> materials from all property owned or occupied by such person: <br /> -24- <br />
