A third or subsequent violation of any <br /> of the provisions of this chapter <br /> classified therein as a petty misdemeanor, <br /> within the immediate preceding twelve ( 12) <br /> month period. <br /> A person charged with a petty misdemeanor shall not be <br /> entitled to a jury trial but shall be tried by a judge without a jury. <br /> If convicted, the person shall be punished by a fine of not more than <br /> One Hundred ($100 .00 ) Dollars. <br /> Any person convicted of a misdemeaor shall be punished <br /> by a fine of not more than Five Hundred ($500 .00 ) Dollars or by <br /> imprisionment not to exceed ninety (90 ) days or both. <br /> Section 2. Effective Date.
