� ' <br /> � y . <br /> ORDINANCE NO. 225 <br /> AN ORDINANCE ESTABLISHING A . <br /> MORATORIUM ON THE INSTALLATION OR <br /> ISSUANCE OF PERMITS FOR THE <br /> . INSTALLATION OF ANY TYPE OF <br /> FENCES OVER 3 FEET 6 INCHES IN HEIGHT <br /> THE CITY COUNCIL OF THE CITY OF ORONO ORDAINS: <br /> The Municipal Code of the City of Orono is amended by <br /> � adding Ordinance No. � to read as follows: <br /> Section 1. Statement of Policy The Council finds that <br /> certain portions� of the Orono Zoning Ordinance, Chapters 30-39 of <br /> the Orono Municipal Code, are currently undergoing study and possible <br /> revision as a part of the City' s ongoing efforts to keep the <br /> performance standards current and to be responsive to the policies <br /> and objectives of the Comprehensive Plan now being developed. As <br /> a part of these revisions, the Council finds that the current <br /> ordinance provisions relating to the height and location of fences <br /> does not meet the current intent of the Council and does not respect <br /> the character of the City. The Council finds that in many cases, <br /> tall, opaque fences have been proposed or actually constructed, <br /> which fences take on the character of "spite fences" limiting views <br /> and open space and adversely affecting the values of neighboring <br /> properties. The Council finds that the current Ordinance needs to <br /> be revised and amended and that a moratorium period is required to <br /> prohibit construction of such fences prior to the adoption of <br /> necessary ordinance revisions. <br /> Section 2. Prohibition During this Moratorium, the <br /> construction or installation of any fence shall require a building <br /> permit from the City prior to the start of construction. During <br /> this Moratorium, no permit shall be issued and no fence shall be <br /> constructed which exceeds 3 feet 6 inches in height without a <br /> variance to this Ordinance. <br /> Section 3. Duration This Ordinance shall expire on <br /> January 16, 1980 without Council action, or it may be renealed earlier <br /> by appropriate Council action. <br /> Section 4. Variances The Council may grant a variance to <br /> - this ordinance if the Council finds after careful review of all the <br /> facts that a proposal is not contrary to �the health, safety, or <br /> welfare of the citizens. . <br /> � <br />
