of any party to grant the City access for this purpose shall be <br /> grounds to classify any system on the property as Non-Conforming. <br /> The City Attorney shall thereafter take such action as is <br /> necessary to enable the City to perform the inspection and to <br /> enforce all the provisions of this code, and to assess the cost <br /> thereof against the property. <br /> 2 . Inspection Report. Within 30 days after the inspec- <br /> tion of each system by the City, the City shall provide the <br /> results of said inspection in writing to the owner of the system, <br /> including the classification of the system as Conforming, <br /> Substandard or Non-Conforming. Notice of Non-Conforming <br /> systems shall include orders for maintenance, repairs or <br /> replacement , the procedures for obtaining all required permits, <br /> the deadline for completion of the construction or pumping <br /> and the penalties for failure to comply with the order . <br /> 3 . Conforming Systems shall be inspected by the City at <br /> least once every two years. <br /> 4 . Substandard Systems snall be inspected by the City <br /> at least once each year . <br /> 5 . Owners of NonConforming Systems shall be issued <br /> orders requiring maintenance , repair , alteration or replace- <br /> ment. Systems found to be nonconforming due to location or <br /> construction shall be relocated and/or made conforming <br /> within one calendar year from the date of the order . Systems <br /> found to be non-conforming due to failure or pollution hazards <br /> shall have remedial action required within a reasonable <br /> period of time as follows: <br /> a) Septic tanks requiring pumping shall be pumped <br /> within 48 hours. <br /> b) Septic tanks or systems found to be clogged, <br /> overflowing, leeching or otherwise discharging <br /> pollvtants shall be pumped within 48 hours an� <br /> thereafter as needed and the system shall be <br /> repaired, altered or replaced within 90 days. <br /> 6 . Collector and Commercial systems required to obtain <br /> and maintain a MPCA State Disposal System Permit shall be <br /> classified as Non-Conforming if the State Permit lapses. <br /> In such case , orders shall be issued to cease use of the <br /> system within 10 days, such use to be discontinued until <br /> reinstatement of the State Permit. <br /> � <br /> 7 . Failure to obey a lawful order requiring repair , ` <br /> alteration or replacement of a Non-Conforming System shall be <br /> cause for the City to enjoin the owner or occupant from further <br /> -14- <br />
