City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1274 <br />WH: 1. David Nelson (hereinafter "the applicant") is the owner <br />of the i-operty located at 740 South Willow Drive within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lot 11, Block 1, Webber Hills, Hennepin County, Minnesota (hereinafter <br />"the prck)erty"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.28, Subdivision 5 (B) to permit the <br />construction of an attached two stall garage to be located 21' from the <br />side lot line where a 30' side lot line setback is normally required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #E1274. <br />2. The property is located in the RR-lB Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on May 16, <br />1988, and recommended approval of the proposed variance based upon the <br />following findings: <br />a. The proposed location of the new garage is appropriate for <br />the following reasons: <br />1. The existing well is located directly behind the <br />existing carport, hence expansion to the rear corner of the <br />house is not practical. <br />2. Attaching the garage in place of the carport would <br />still require a side setback variance and would place the <br />existing main entryway to the house inside the garage. The <br />proposal leaves an entry walkway between the garage and the <br />house, providing a more useable formal entryway. <br />3. Attaching the garage to the front of the house would <br />conflict with the main living room window system. <br />Page 1 of 4 <br />
