Drainage easement: The 'drainage easement' on the survey/original plat defines the boundary of <br />the area originally protected by C&F easement with the Abingdon Glen subdivision. Now that <br />wetlands have been delineated and the delineation shows wetland boundaries differently than the <br />conservation easement, a question is raised as to whether the C&F easement should be revised to <br />reflect the new wetland boundaries. It appears to staff from the wetland report that many of the <br />wetland areas that weren't defined in 1983 are Type 1/2 wetland which the City in recent years <br />has opted to not formally protect by easement but rather by filing in the chain of title a document <br />notifying current and future owners that there are WCA wetlands on the site which are regulated. <br />There are several options the Planning Commission could consider: <br />1. Do nothing. Keep the delineation report on file in case additional work is done on the <br />property. <br />2. Require that the property owner grant the city a revised C&F easement for the portion of <br />the wetland not included in the easement at the time of subdivision. (This option is <br />costly-would require a new legal description, survey and filing of easement). <br />3. Acknowledge the non-City protected, \VCA-protected wetlands via a notification <br />document to be filed in the title. <br />Site Lighting: Applicants intend that the tennis court be convertible to hockey rink use in the <br />winter. They intend to provide lighting around the structure. This has raised the concern of at <br />least one nearby property owner, and night lighting has been an issue in this neighborhood in the <br />past, and in rural Orono in general. Ice is light colored and highly reflective, and even lights <br />shining down on it will have an impact of lighting up the night sky. Consideration should be <br />given to use of shoebox downward cast lighting with diffusers of some sort to reduce the impacts <br />of reflective glare, and perhaps timers or other methods should be used to ensure the lights are <br />turned off when not in use. <br />Tim/Gayle Devries <br />2180Abingdon Way <br />PC 8/19/02 <br />Page4 o/5
