RELEASE OF INTEREST <br />THIS RELEASE is made this :i!!}_ day of LJ,h'eVhbo-, 1999, by the City of <br />Orono, a municipal corporation under the laws of the State of Minnesota ("City"). <br />WHEREAS, C. Steven Wilson and Susan D. Wilson, husband and wife <br />("Wilson"), are the fee owners of property located in the County of Hennepin, State of <br />Minnesota, legally described as Lot 5, Block 1, ABINGDON GLEN ("Property"); <br />WHEREAS, the Property is subject to that certain Declaration of Private Road <br />Easement and Declaration of Covenants recorded February 10, 1984, as Document No. <br />1562404 in the office of the Hennepin County Registrar of Titles ("Declaration"); <br />WHEREAS, the Declaration provides that, in the event the City is required to <br />maintain the private road described in said Declaration ("Private Road"), the City has the <br />right to place a lien on the Property for a proportionate share of the cost of said <br />maintenance; <br />WHEREAS, Wilson applied to the City of Orono for subdivision of the Property <br />into the following Parcels: <br />That part of Lot 5, Block 1, ABINGDON GLEN, according to the plat thereof on <br />file or ofrecord in the office of the Registrar of Titles in and for Hennepin <br />County, Minnesota, that lies west of the east 60.00 feet thereof ("Parcel 1 "); and <br />The East 60 feet of Lot 5, Block 1, ABINGDON GLEN, according to the plat <br />thereof on file or ofrecord in the office of the Registrar of Titles in and for <br />Hennepin County, Minnesota ("Parcel 2"); <br />. WHEREAS, Wilson desires that Parcel 2 be released from the terms and <br />conditions of the Declaration, including the City's rights to lien thereunder; and
