Zoninq File #1211 <br />April 21, 1988 <br />Page 2 <br />5. Approximately 1.5 acres of dry buildable area will remain within <br />the portion of Lot 8 west of the proposed driveway easement. Planning <br />Commission reviewed Municipal Code Section 10.03 Subdivision 6 (B), <br />and felt that this being a driveway easement only, and not a road <br />Easement, would not be interpreted as leaving Lot 8 with substandard <br />area. It is a fact, however, that regardless of the driveway <br />easement, if we were to redefine the wetlands in Lot 8, there is a <br />possibility that Lot 8 would contain less than acres of dry <br />buildable land. Since that house is already constructed this would <br />not appear to significantly affect development of Lot 8. <br />Staff Recommendation <br />Given the circumstance that development of a <br />driveway <br />thru the <br />middle <br />of the wetland appears unfeasible, staff feels it <br />is appropriate to <br />allow <br />and encourage construction of a driveway over the <br />proposed <br />easement <br />on Lot <br />8, finding that a driveway base already exists, <br />and for <br />all but a <br />short <br />segment is 26' or more from the wetland, subject to <br />the following <br />conditions: <br />a. The 3 segments of culvert in poor condition at the drainagewav <br />crossing near the boundary between Lot 7 and Lot 8, shall be removed <br />and replaced with a single 24 inch culvert. <br />b. To the greatest degree possible, the sand fill shall be removed <br />from the area of the unsuccessful driveway construction, and the <br />wetland allowed to return to its previous natural state. <br />C. The driveway to be developed within Lot 7 shall be constructed to <br />avoid conflict with the approved primary and alternate drainfield <br />sites. <br />d. The existing grading and filling permit obtained by applicants <br />contractor shall remain in effect for the removal of fill and <br />construction of the newly proposed driveway. Applicants contractor <br />shall call for a final site inspection of both driveway sites once the <br />sand fill is removed and the new culvert is placed. <br />Staff recommends approval per the attached resolution. <br />
