Since that memo, staff has <br />walked the proposed revised driveway route. Some additional facts have <br />been verified by staff, as follows: <br />1. Gerald Neslund, owner of Lot 8 and one of the deve , opers of Orono <br />Oaks, initially in selling Lot 7 to McCaffrey refused ..o grant them an <br />easement over Lot 8 for driveway purposes. Now, since the McCaffrey's <br />are experiencing major problems in development of a driveway, <br />they note that Neslund has agreed to grant such an easement. <br />2. It was apparen"ly Neslund's intent from the start to access Lot 7 <br />via easement thru Lot 8, since when the house on Lot 8 was constructed <br />in 1979, the base work for the driveway now proposed was completed, <br />and a culvert placed across the minor drainageway at the northwest <br />cornor of Lot 7. <br />3. The existing driveway base work generally is 26' or more from the <br />edge of the wetland as we would interpret it today, except for a <br />portion of that driveway approximately 100' south of Orono Oaks drive. <br />Note that the Wetlands Conservation and Flowage Easement on Lot 8 is <br />approximately 90' away from the proposed driveway at this point. <br />4. The proposed driveway easement location will have no effect on <br />future drainfiela sites on Lot 8, and within Lot 7 the driven :an <br />be constructed to easily avoid conflict with proposed primar And <br />alternate drainfield sites. <br />
