Lit of ()-[�.ON( <br />..`•`,`� 'Nvss.3, RESOLUTION OF THE CITY COUNCIL <br />NO. 22,11 <br />4' O <br />:9J t <br />A RESOLUTION GRhNTING <br />PRELIMINARY APPROVAL OF A <br />SUBDIVISION OF LOTS 2 AND 3, <br />PETER14AN AriDITION <br />OF WEAR ENTERPRISES PARTNERSHIP <br />APPLICATION NO. 1169 <br />WHEREAS, William Wear, an authorized agent of Wear Enterprises <br />Partnership, (hereinafter "the applicant") filed a formal subdivision <br />application with the City on June 25, 1987 for the purpose of platting 6 <br />lots of the property legally described as follows: <br />The south 22 acres of the Southeast Quarter of the Southwest Quarter <br />of Section 33, Township 118, Range 23, Hennepin County, Minnesota. <br />EXCEPT the west 225 feet of the east 645 feet of the south 415.6 feet <br />thereof (hereinafter "property"); and <br />WHEREAS, after due publi^hed and mailed notice in accordance with <br />Minnesota Statues 462.358 et. sec. and the City of Orono Zoning and <br />Subdivision Codes, the Oronc Planning Commission held a public hearing on <br />July 20, 1987 at which time all persons desiring to be heard concerning <br />this application were given the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on November 9, 1987, the <br />Orono City Council considered the subdivision application of the applicant <br />noting the following findings of fact: <br />1. The property is located within the RR-lB Single Family Rural <br />Residential zoning district requiring a minimum of 2 acres of dry land <br />within each newly created lot. <br />2. The property contains a total of 18.50 acres of dry contiguous <br />land. <br />3. All six lots shall be served by a private road for which the <br />placement and curb cut have been approved by the City Engineer. <br />4. All lots meet the required 200 feet width adjacent to private road <br />and at the front yard setback line. <br />5. A single family residence can be constructed on all proposed lots <br />without the need for further variances. <br />6. Septic testing has confirmed that all six lots contain adequate and <br />suitable soils for on -site sewage disposal systems. <br />Page 1 of 3 <br />
