The City Council has considered a is application including the findings <br /> and recommendation of the Planni g Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> variance and conditional use permit on the health, safety and welfare of <br /> the community. <br /> 5. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply gen-rally to other property in this zoning <br /> district; that granting the conditiona use permit would not adversely affect <br /> traffic conditions, light, air nor p.se a fire hazard or other danger to <br /> neighboring property; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensi e Plan of the City. <br /> CONCLUSIONS, ORDE• AND CONDITIONS <br /> Based upon one or more of the above fin 1 ings, the Orono City Council hereby <br /> grants a conditional use permit for fill in excess o 1500 cubic yards per Orono Municipal <br /> Zoning Code Sections 78-967 (B) (2), & 78-128: (D) (2) to incorporate approximately <br /> 2,200 cubic yards of fill into the property, subject to the following conditions: <br /> 1. Council approval is based on the grading plan submitted by the applicants and <br /> annotated by City staff, attached to t is Resolution as Exhibit B. Any <br /> amendments to the grading plan may req ire further Planning Commission and <br /> City Council review. <br /> 2. The amount of fill brought onto the Prope y shall be monitored so as to ensure <br /> compliance with the approved grading pla .
