MORRISON <br />Re: Amendment to Dangerc)us Weapons aril Art_i,les Ordinance <br />Dear Mark: <br />Chief Kil.bo and Scott Richter have noted an apparent <br />omission in City Ordinance Section 9.10, subdivision 3, a copy of <br />which is attached. Scott asked me to review the ordinance, and <br />if necessary, initiate an amendment. <br />Section 9.10, subdivision 3 relates to the discharge of <br />explosives and firearms. Although the title of the subdivision <br />references explosives, the test does not specifically prohibit <br />the use of explosives. The existing reference in the title alone <br />would probably not support in enforcement action. Thus, under a <br />narrow reading of the ordinance, someone caull set off dynamite <br />and not be s:ibject to this provision. 1 s-jspect this omission <br />represents a /grafting or clerical error. <br />I woulli suggest that Section 9.10, subdivision 3 be amended <br />to rend: <br />Discharge of Firearms and Explosives. It ic- Lnl4wful for <br />any person to fire or Iischargo 4ry form or type of <br />explosive or explosive t:ev1,.; L=+) nnon, gun, pistol, or <br />of er rearm, firecrAcVerr, sly rocket or other fireworks <br />►pow and arrow, air gun, air rifle, or other simil:1,i ievice <br />commonly referred to as a n-4 gun.
