City of OR ONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. _ <br />A RESOLUTION VACATING AN <br />UNUSED PORTION OF VINE PLACE AND <br />A PORTION OF A PARK <br />WITHIN THE PLAT OF SAGA HILL REVISED, <br />SECTION 7, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on February 26, 1988, Theodore O. Metz and Mary J. Metz <br />filed a petition with the City of Orono requesting the vacation of a <br />portion of an undeveloped park and a portion of Vine Place originally <br />dedicated in the Plat of Saga Hill Revised legally described as follows: <br />That part of vacated Vine Place and vacated Park as <br />dedicated in the plat of "Saga Hill Revised, Hennepin <br />County, Minnesota" which lies between the Northwesterly <br />extensions across there of the Southwesterly line of Lot <br />2, Block 16, Saga Hill Revised, Hennepin County, <br />Minnesota, and the strai '-- portion of the <br />Northeasterly line of Lot 1, sai :clock 16; and <br />WHEREAS, after due published and posted notice, a public hearing <br />was held before the City Planning Commission on March 21, 1988, regarding <br />said vacation and all interested persons were given an opportunity to be <br />heard; and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission recommended approval of the requested vocation and the Council <br />of the City of Orono finds that said vacation as p -oposed, is in keeping <br />with the public interest in consideration of the following findings: <br />1. The vacation does not affect the access or the use of any <br />adjoining property. <br />2. The Ci#-y hr ; not and dues not intend tc develop, improve, or use <br />the dedicated right-of-way as a road. <br />3. The City has not and does not intend to maintain or install <br />utilities within the dedicated right-of-way of the road or tree park <br />a:ea as described above. <br />4.
