City Of ORONO <br />RESOLUTION OF THE CITY CCUNCIL <br />1 t. fd NO. <br />Low <br />5•W11� � <br />A RESOLUTION VACATING AN <br />UNUSED PORTION OF FOREST BOULEVARD <br />WITHIN THE PLAT OF SAGA HILL REVISED, <br />SECTION 7, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on February 26, 1988, Frederick J. Shearer and Karen <br />Shearer filed a petiticn with the City of Orono requesting the vacation of <br />a portion of Forest Boulevard originally dedicated in the Plat of Saga Hill <br />Revised legally described as follows: <br />That part of vacated Forest Boulevard as dedicated in <br />the plat of "Saga hill Revised, Hennepin County, <br />Minnesota" which lies between the Northwe-,'-erly <br />ex,:.ensions across it of the Southwesterly line of Lot <br />1, Block 15, "Saga Hill Revised, Hennepin County, <br />Minnesota" and the straight part of the Northeasterly <br />line of said Lot 1; and <br />WHEREAS, after due published and posted notice, a public hearing <br />was held before the 'ity Planning Commission on March 2.1, 1988, regarding <br />said vacation and all intere: ted persons were given an opportunity to be <br />heard; and <br />WHEREAS, after due standing and consideration, the '-lanning <br />Commission recommended approval of the requested vacation and tYe Council <br />of the City of Orono finds that said vacation as proposed, is in keeping <br />with the public interest in consideration of the following find4ngs: <br />1. e vacation does not affect the access (-t the use o' adjoining <br />prop ties. <br />2. The City has not and does not intend to p, Improve, or use <br />the dedicated right-of-way of Forest Boulevard for road purposes. <br />3. The City has not and does not intend to maintain or install <br />utilities within the dedicated right-of-way of Forest Boulevard. <br />4.
