City of OR ONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION VACATING AN <br />UNUSED PORTION OF FOREST BOULEVARD <br />WITHIN THE PLAT OF SAGA HILL REVISED, <br />SECTION 7, TOWWSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />WHERizAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHE.tEAS, on February 26, 1988, Edward G. Newton and Marlene <br />Newton filed a petition with the City of Orono requesting the va -)n of <br />a portion of Forest Boulevard originally dedicated in the Plat of Saga Hill <br />Revised legally described as follows: <br />That part of vacated Forest Boul�-,varO as dedicated in <br />the plat rf "Saga Hill Revisea, -�nnepin County, <br />Minnesota which lies between the Northwesterly <br />extensi�-, s acru-s it of t h•. vr. : terly portion of the <br />Northeast`rly line c -it 2, Block 1, Sidwell Addition, <br />and the westerly poicion of the Southwesterly line of <br />said lot 2; and <br />WHERunS, after due published and posted notice, a public hearinc, <br />was re'.n before the '.y.ty :Tanning Commission on March 21, 1988, regarding <br />said vacation an i it ` interested persons were given an opportunity to be <br />heard; and <br />WHEREAS, atit.=:_ due standing and consideration, the Planning <br />CoR:mi ssien recommende,:' Apprc:va 1 of the requested acation and the Council <br />of the City of Orono finds that saie vacation as proposed, is in keeping <br />with the public interest in consideration of the following findings: <br />1. The vacation does nvt affect the access or the use of adjoining <br />properties. <br />2. The City has not and does not intend to develop, improve, or use <br />the dedicated right-of-way of Forest Boulevard for road purposes. <br />3. The City has not and does not intend to maintain or install <br />utilities within the dedicated right-of-way of Forest Boulevard. <br />4.
