�- . <br /> i <br /> l Cit� of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> • <br /> NO. 1285 <br /> • � • • <br /> 5) There has been an established residence on <br /> the property for over 50 years . <br /> 6) The e�cisting residence is served by sewer. <br /> 7) The abutting property owners have voiced <br /> no objection to t.he proposed improvements . <br /> 8) The special conditions applying to this <br /> property are peculiar to such and do not <br /> apply generally to other land in the dis- <br /> trict in which said land is located. <br /> 9) The granting of the application is neces-- <br /> sary for the preservation and enjoyment <br /> of a substantial property right of the <br /> applicant. <br /> 10) The granting of the proposed variance will <br /> not in any way impair the public health, <br /> safety, comfort, morals or general welfare. <br /> • 1_1) The granting of the proposed variance will <br /> not be contrary to the intent of the Com- <br /> prehensive Land Use Plan or the Zoning Code. <br /> 12) The granting of such variance will not merely <br /> serve as a convenience to the applicant, but <br /> is necessary to alleviate demonstrated hard- <br /> ship and difficulties . <br /> FLJRTHERP�IORE, BE IT RESOLVED that based upon the foregoing <br /> findings the City Council approves the many variance required for <br /> the construction of a new home located at 1410 Rest Point Road <br /> subject to the fol.lowing conditions : <br /> 1) All new construction or hardcover must be <br /> contained within the following approved. <br /> building envelope: See Attached Exhibit A. <br /> a) 40 ' lakeshore setback - Council will <br /> approve an 8 ' encroachment by the garage <br /> and a 25 ' encroachment by the driveway <br /> because of the location of the City <br /> road serving the pro�erty. <br /> b) 10 ' from north property line <br /> 2) All improvements on site to include not only <br /> the principal structure but patio areas , walk- <br /> • �,�3ys and paved and/or gravel driveways may not <br /> exceed 3200 sf of hardcover. <br />
