NO. <br />v e. <br />A RESOLUTION ORDERING ABATEMENT <br />OF HAZARDOUS BUILDING :*CTION AT <br />2339 OT.IVE AVENUE, ORONO <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, Helen M. Bergquist of 2339 Olive Avenue, Wayzata, MN <br />55391, is the fee owner of record and Robert Nelson of 4129 Dupont Avenue, <br />Minneapolis, MN 55412 is the agent of property located at 2339 Olive <br />Avenue, Orono, Minnesota, herein referred to as "the property", and legally <br />described as follows: <br />P.I.D. 17-117-23 44 0075, Lot 17, Wi ley's Navarre Addition, Lake <br />Minnetonka, that part of Lot 17 lying Southeasterly of the <br />Northwesterly 6 inches thereof, Hennepin County, Minnesota, <br />(hereinafter "the property"); and <br />WHEREAS, the City Council of the City of Orono, having duly <br />considered the matter pursuant to Minnesota Statutes Sections 463.15 to <br />463.261, hereby finds that the above described property is uninhabitable <br />and contains unsanitary and hazardous conditions which constitute a public <br />nuisance and which makes this property hazardous to the public health, <br />safety and welfare based on the following findings: <br />INTERIOR <br />Basement <br />1. Foundation Footings - failing - walls are sinking at exterior <br />walls. UBC 2907(b). <br />2. Foundation Walls - failing - sinking. UBC 2907(b). <br />3. Joists - floor joist for 1st floor bowed 6" to 12" (center to <br />exterior wall). UBC 2501(d). <br />4. Rim Joist Insulation - none provided. SBC 602.2..3. <br />Kitchen <br />5. Floor - large bow in middle of floor. UBC 2501(d). <br />6. Walls - water damaged. UBC Standard 47.1109. <br />7. Ceiling - water damaged, ceiling readp to fall.
