The three cities involved with <br />the major upgrading (Spring Park, Mound, Orono) have worked closely with <br />the County on the planning of this upgrading for over three years. The <br />final plan as presented to the Council and the City were once again <br />reapproved approximately two months ago. Upon review by the Orono staff, <br />it was determined that a land use application would have to be filed by the <br />County in order to cover the encroachment of the wetland and floodplain <br />area and the filling adjacent to the shoreline at the western edge adjacent <br />to the Spring Park border. <br />Wetland/Floodplain Encroachment - Review Exhibits H, I, and J <br />Both the DNR and MCWD have required permit reviews for the encroachment of <br />the wetland/floodplain areas. Review exhibit D. The DNR waived the permit <br />review ana issued a permit for the project finding a lack of another <br />feasible and practical alternative based on the public need rule <br />outweighing the no build alternative. Review Cook's letter (exhibit F) and <br />exhibits H and I. Total area encroachment of the filling of the <br />wetland/floodplain area totals .05 acres. Cook advises that the <br />excavation of the ditch on the north side of County Road 15 will replace <br />the storage capacity of the wetland/floodplain areas filled with the <br />project. Part of this project involves replacement of the culvert under <br />County Road 15 increased from 24" to 30". The actual control of the <br />drainage from the wetland is at the 24" culvert at Casco Point Road on the <br />south side of 15 and further east. The major drainageway to Carmens Bay <br />travels from that wetland area under County Road 15 and then eastward on <br />
