T <br />Zoning File #1082 <br />November 7, 198b <br />Page 2 of 2 <br />It may be true that by tacitly allowing the regrading at 425 Old <br />Crystal Bay Road, the City may have contributed to Dougan's <br />problems to some degree. <br />Giver, facts and the facts presented in the staff memo of <br />10/17/86, staff recommends approval noting that even though the <br />proposed pond and swale project may not stop ponding of water on <br />Dougan's property, it may give some relief to the applicant's <br />dranfield area which is occasionally flooded. Staff recommends <br />that the applicant be required to execute a developer's agreement <br />and post suale fvzm of security, and grant both a drainage <br />easement and flowage and conservation easement over the project, <br />with legal description in this case to be provided by the City <br />Engineer. <br />A resolution for approval is attached for Council's review. <br />
