56. <br />B. <br />Nature of. Long Lake Undertaking. In <br />no event shall this <br />57. <br />agreement be <br />construeu to fix upon Long Lake any <br />rest— ibility or <br />58. <br />liability to <br />Orono or to third parties which are <br />gre-. ?r or different <br />59. <br />in kind than <br />the responsibilities and liabilities <br />Torre by Orono <br />60. if it were providing such services through its own fire department. <br />61. Without limiting the generality of the foregoing, the fire chief of <br />62. Lonc, Lake or his deputy will have the sole discretion as to the mer. <br />63. ar.d equipment that will answer each alarm, provided that protection <br />64. will be reasonable considering available men and equipment, and it <br />65. shall not be a violation of this agreement nor shall Long Lake be <br />66. held responsible to Orono or a thir,9 party for any loss which may <br />67. result in the event Long Lake, in the exercise of reasonable judgement <br />68. is unable to respond or to respond promptly or to respond with only <br />69. limited men and equipment, or is delayed in responding to a call by <br />70. reason of answering a previous call. Orono agrees that it will <br />71. indemnify Long Lake for any judgement rendered against it or sums <br />72. paid out by it in settlement, payment or defense of any such claims. <br />73 8. As and for compensation for the said fire protection, Li <br />74 Lake shall charge Orono, and Orono shall ray to Long Lake, a sum <br />Dual to that percentage which Orono's limited assessed valuation <br />76. within the said corporate limits served by Long Lake is to the total <br />77. limited assessed valuation of ott-r municipalities or persons under <br />78. contract for like --r similar fire protection provided by Long Lake, <br />79. including Lonri Lake's limited assessed �alua`.ion, tines the annual <br />RO.
