City of OR ONO <br />RESOLU1 ION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION ORDERING ABATEMENT <br />OF HAZARDOUS BUILDING ACTION AT <br />3405 LIVINGSTON AVENUE, ORONO <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, Sheryl Bingaman 6 Dale R. Richardson of 3405 Livingston <br />Avenue, Wayzata, MN 55391 are the fee owners of record and Valerie Barnes <br />of 8120 Penn Avenue South, Suite 540, Bloomington, MN 55431 is the agent <br />of property located at 3405 Livingston Avenue, Orono, Minnesota, herein <br />referred to as "the property", and legally described as follows: <br />Lots 1 and 2, Block 5, Navarre Heights, Hennepin County, Minnesota, <br />(hereinafter "the property"); and <br />WHEREAS, the City Council of the City of Orono, having duly <br />considered the matter pursuant to Minnesota Statutes Sections 463.15 to <br />463.261, hereby finds that the above described property is uninhabitable <br />and contains unsanitary and hazardous conditions which constitute a public <br />nuisance and which makes this property hazardous to the public health, <br />safety and welfare based on the following findings: <br />INTERIOR <br />Basement <br />1. Foundation is cracking. This also includes secondary foundation <br />which was installed because of failure of existing foundation from <br />later&i pressures. <br />2. Walls - column in basement is undersized and inadequate for <br />loading per UBC 2504 b. <br />3. 1eilings - open joist and undersized (see 1st floor ceilings). <br />First Floor <br />4. Walls - water damaged. Improper support for beam in kitchen per <br />UPC 2507 (g) 5. <br />5. Ceilings - sheet rock caving in from water damage. <br />6. Floors - joist size and spacing does not meet UBC Section 2517 <br />(d). Floors slope excessively denoting poor support. <br />Second Floor <br />7. Walls - some rooms do not meet minimum area requirements pursuant <br />to ►-.1BC 1207 (b) . <br />Page 1 of 5 <br />
