CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.7606 <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTIONS 6.12.1450 & 6.12.6240 <br />FILE NO. LA25-000023 <br />WHEREAS, on June 16, 2025, on behalf of the property owners, David Charlez Designs <br />(hereinafter the "Applicant"), applied for a variance from the City Code for the property addressed <br />1390 Rest Point Road, and legally described as: <br />Lot 4, Subdivision of Lot 14, Rest Point Park, Hennepin County, Minnesota <br />(hereinafter the "Property"); <br />WHEREAS, the Applicant has made application to the City of Orono for a variance from <br />Orono Municipal Zoning Code Section 6.12.1450 to allow a 2nd story addition to be set back <br />20.7 feet from the rear, street property line where a 20.7-foot setback exists and 30 feet is <br />required; and <br />WHEREAS, the Applicant has made application to the City of Orono for variances from <br />Section 6.12.6240 to allow a 2nd story addition to be constructed 67 feet from the OHWL, where <br />a 75-foot setback is required over the existing home footprint and 4 feet lakeward of the average <br />lakeshore setback line. A minimal increase in the elevation of the existing deck is also <br />requested within the 75-foot setback to meet the door threshold; and <br />WHEREAS, on July 21, 2025, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS, on July 21, 2025, the Planning Commission recommended approval of the <br />requested variances; and <br />WHEREAS, on August 11, 2025, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota, <br />hereby approves the requested variances as described above based on one or more of the <br />following findings of fact concerning the Property: <br />73 <br />
