AGENDA ITEM <br />Date: August 11, 2025 <br />Title: LA25-000023, 1390 Rest Point Road, Variances - Resolution 7606 <br />Presenter: Melanie Curtis, Planner <br />Section: Consent Agenda <br />Item: 12 <br />Purpose: <br />The purpose of this request is to consider variances from the 75-foot lake setback, average <br />lakeshore setback, and rear yard setback to allow construction of an expanded 2nd story addition <br />over the existing home and a minimal increase in the elevation of the existing deck. <br />2. MN§15.99 Application Deadline: <br />The application was submitted on June 16th, and considered to be complete on June 25, 2025. The <br />60-day review timeline will expire on August 24, 2025. <br />3. Background: <br />The property is nonconforming in size. The existing home encroaches lakeward of the average <br />lakeshore setback line (ALS) and the 75-foot lake setback; it also encroaches 10 feet into the <br />required 30-foot rear setback. The new owners are proposing 2nd story additions to increase the <br />living space on the 2nd level of the home while maintaining the existing footprint. They also <br />propose a minimal increase in height of the existing low-level deck to create a level threshold (no <br />step down). No footprint expansions are proposed. Please refer to the Planning Report attached as <br />Exhibit C for a detailed analysis. Page 7 of Exhibit B is a 3D rendering showing the new massing <br />areas. <br />4. Planning Commission Vote and Comment: <br />On July 21 st the Planning Commission held a public hearing and discussed the requested <br />variances. There were no public comments provided during the meeting. The Planning <br />Commission voted 4 to 0 in favor of approving the variances as applied. The draft minutes are <br />attached as Exhibit D. <br />Public Comment: <br />Public comments were received in favor of the project. Comments are attached as Exhibit E. <br />6. Staff Recommendation: <br />Staff recommends approval as applied. <br />COUNCIL ACTION REQUESTED <br />Council should adopt Resolution No. 7606, approving the variances as applied. <br />Exhibits <br />A.
