AGENDA ITEM <br />Date: August 11, 2025 <br />Title: LA25-000016, 2545 Dunwoody Avenue, Conditional Use Permit - <br />Resolution 7605 <br />Presenter: Matt Karney, Planner <br />Section: Consent Agenda <br />Item: 11 <br />Purpose: <br />The applicant requests a conditional use permit for replacing retaining walls within the lakeshore <br />setback. <br />2. MN§15.99 Application Deadline: <br />The application was made on April 2, 2025 and deemed complete on April 17, 2025. The 60-day <br />review period has been extended by staff an additional 60 days, to expire on August 15, 2025. The <br />applicant waived their review timeline on July 3, 2025. <br />3. Background: <br />The applicant requests a Conditional Use Permit (CUP) for a new retaining wall system to support <br />a lake stair where existing walls and a lake stair are in need of repair. The walls are proposed in a <br />similar location to the existing conditions, but will involve a change in material to both the lake <br />stair and walls. A landscape plan has been provided to depict how the walls will be screened from <br />Lake Minnetonka. The primary residence on the property is permitted and currently under <br />construction, as a separate project. <br />The applicant has revised their landscape plan following the July 21, 2025 Planning Commission <br />to address a planting that was found to be on the Department of Agriculture's restricted noxious <br />weeds list. Planning Commission Vote and Comment: <br />On May 19, 2025, the Planning Commission held a public hearing and discussed the CUP <br />application. No public comment was made. The Commission noted that the proposed retaining <br />wall improvements were excessive and the application was missing information including a <br />landscape plan and an engineering letter. The Planning Commission voted to table the application <br />to allow the applicant to revise their submittal to address concerns the proposed walls were more <br />impactful than the existing walls to be replaced. (Link to Meeting Video) <br />On July 21, 2025, the Planning Commission discussed the CUP application, following the <br />applicant revising their proposal. The Planning Commission discussed the project, and concluded <br />the revisions made addressed the concerns raised during the first meeting. The Planning <br />Commission voted 4-0 to recommend approval of the CUP, contingent on the applicant submitting <br />an engineer's letter prior to the City Council meeting on August 8, 2025.
