Resolution No . /099 � <br /> � Page 83 <br /> D, GOVERNMENT REGULATIONS <br /> 1. All the various regulatory bodies have similar <br /> rules and regulations for the common purpose of <br /> protecting valuable natural resources and pro�noting <br /> the most general public welfare. Differences , tahere <br /> they occur, arise because of the varying perspective <br /> and special jurisdiction established for each agency. <br /> 2. Because of the legislative overlapping of the <br /> various governmental jurisdictions, the regulations <br /> and ordinances of the various agencies are also . <br /> overlapping in many instances . j�There this overlapping <br /> occurs, the most restrictive regulation applies . <br /> 3. j�TOrk requiring review or permits from several � • <br /> agencies must undergo detailed review by each. � <br /> The Council is working to minimize this duplication, <br /> but in the interim, applications must receive approval <br /> . and meet the regulations of all jurisdictions . In <br /> effect, each agency has veto power over any project. <br /> 4. The LMCD has jurisdiction over boat use, storage <br /> and dock structures in the waters of Lake Minnetonka. <br /> Stubbs Bay Niarina is required to obtain an annual <br /> multiple dock license and to meet all the setback <br /> regulations of the LMCD. One condition of licensing <br /> is that .the property use must be consistent with <br /> 1oca1 zoning regulation. � <br /> � a) As noted on the exhibits, neither the inplace <br /> McCleary docks nor the proposed Johnson docks <br /> " conform to the LMCD (and City) setback requirements . <br /> ':ti . <br /> b) The proposed McCleary docks (�xhibit U-2) do <br /> confo�n to setback requirements but may be too <br /> congested to meet DNR State Fire Code requirements . <br /> c) The docks in place along the residential shoreline <br /> . may not be used for commercial purposes . <br /> • . � - . <br />
