Johnson' s formal license application in February, <br /> 1979 caused formal review of his development plan. - <br /> After deep study by the Council, reviews by the City - <br /> staff, and comments by the public at the public hearing, <br /> the Council decided th at the Johnson plan was too <br /> ambitious given the needs of the area and the environ- <br /> mental constraints of the site. Certain technical <br /> difficulties or discrepancies were also found in the <br /> plan. <br /> 25. The Council conceptually disapproved the scope : <br /> of the Johnson plan in Resolution 1005, and called for <br /> th is Resolution to set forth all the f indings in th e � <br /> record and the conclusions evident and made from <br /> those findings. <br /> 26. The conceptual denial apparently caused Johnson <br /> to abandon his involvement with the property. . <br /> � 27. McCleary thereafter notif ied the City that he <br /> would be responsible for the property. The City <br /> staff then notified McCleary that the 1979 dock <br /> license for Stubbs Bay was not in order. As of <br /> April 16, 1979, McCleary had not returned a dock <br /> _ license application although he had been sent the <br /> � form in December, 1978 along with all other 1978 Marina <br /> licenses. . <br /> 28.. McCleary has proceeded to advertise dock space <br /> for rent and to make arrangements for operation in- <br /> •- 1979 despite �clear City direction that a ,proper <br /> license application and physical improvements need <br /> be made before a 1979 license would be issued. In <br /> particular, no attempt has been made to correct the <br /> � existing dock structure `condition or setback viola- <br /> tions. . <br /> 29. For the record, since the Johnson involvement <br /> began in 1978,. notice of every Council meeting involv- <br /> ' ing the Marina Property, including copies of all � <br /> documentation and staff reports supplied to� the Council <br /> for their review, has been given to all interested <br /> � . parties alike, including Johnson, McCleary, McCleary' s <br /> . . attorney of recoxd, Keiran, and Keiran' s attorney of <br /> record. � <br />
