Additionally,. in 1974 and 1975, McCleary attempted <br /> to expand the commercial use of the property by expansion <br /> of the existing tavern into a restaurant or "cafe", <br /> � " _ contrary to 1967 and 1974 use provisions of the zoning <br /> � . code. . . <br /> 14. Mc�leary' s 1975 license for 66 slips was an <br /> additional increase in permitted use of the property, <br /> based in part on incorrect sta-tements alleging such a <br /> 66 slip license in existence from the LMCD. <br /> 15. Mc�leary' s 1975 Operations Agreement with the City <br /> called for certain landscaping and maintenance standards <br /> which have never been completed. � . <br /> �. 16. Mc�leary' s 1976 license application requested <br /> additional boats 50% beyond the increase granted in 1975. <br /> A large marina service and restaurant building was <br /> � � proposed. �learly the intent was to dramatically <br /> increase corranercial use of the property. <br /> 17.. Ironically, instead of increasing the property use, <br /> a November, 1976 fire instead presaged a decline in the <br /> property use. New building plans were submitted along <br /> with still another increased request for additional <br /> � boats (total 192 boats compared to 31 in 1974 - increase <br /> 619% in three years !) . When a smaller service� building <br /> only, `and no increase in boat density over 1976 was <br /> approved by the �ity, McCleary failed to proceed with : <br /> reconstruction. The docks decayed, the weeds grew and <br /> no on-site services were provided: Only 43 boats were � <br /> kept on the property, less than the licensed amount. <br /> Rumors circulated that the property was for sale. <br /> S <br /> 18. In 1977 and 1978, McCleary pursued various requests <br /> for dredging and rezoning, liquor and restaurant permits , <br /> but did not actively maintain or rebuild the property <br /> � despite dock license approval and building permit issuance. • <br /> j� . • <br />
