Keiran ' s 1967 license application acknowledged � <br /> that the property was residentially zoned and that .� . � <br /> the resort was a non-conforming use. � �. <br /> 8. Keiran ' s lzcense application increased from 18 ' � <br /> boats in 1967 to 32 boats in 1968 after adoption <br /> of the new zoning ordinance establishing the B-2 <br /> Distri�t. The �.icense was issued for 31 boats <br /> �13 rental' boats and 18 rental slips) despite <br /> neighborhood protests on record. T'his is the first - . <br /> instance of changing the intent of the licensing �� <br /> procedure from licensing of 18 boats (as in the past) <br /> • to licensing of 18 "slips" plus additional "boats". <br /> � 9 . Keiran was licensed for 31 boats in 1973 but sold � <br /> to Mc�leary by contract for deed in April. The City <br /> license was never transferred to Mc�leary. The Resort <br /> was never substantially altered from 1956 through <br /> • 1973 while Keiran was the operator. <br /> 10. Mcvleary in 1973 applied for an LMCD license but <br /> with a different dock plan and for 60, not 31 slips . <br /> He incorrectly certified that "no changes are to be <br /> made in the dock use area . . .�. . during the 1973 season; <br /> that the scaled drawing or certificate submitted with <br /> last year ' s <1972) application will be applicable to <br /> the license applied for" despite the major changes <br /> from the" 3T slip Keiran licenses . <br /> 11. McCleary applied� for and received a 31 slip City <br /> license in 1974 with a dock plan identical to Keiran ' s : <br /> 1968 plan lthe docks were still in placel . Without <br /> prior approval, and contrary to the license, McCleary <br /> then proceeded to erectsan entirely different dock <br /> layout for 75 'slips, including slips encroaching in <br /> front of the newly purchased residential parcel 4. <br /> . 12. The City Council on July 23, 1974, ordered McCleary � -- <br /> to cease use of the "residential" property and to abide <br /> by City licensing standards. This record, occurring <br /> � during the final stages of the comprehensive planning <br /> and rezoning process, clearly shows the intention of <br /> keeping parcel 4 zoned residential, without apparent <br /> knowledge of the 1967' legal description. � <br />
