� RESOLUTION N0. ��99 <br /> A RESC�LUTION REGARDING DEVELOPMENT <br /> . OF THE STUBBS BAY MARIATA PROPERTY <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and eaisting under the laws of the State of �innesota ; and <br /> jaHEREAS, the State of Minn�sota under State Statute <br /> Chapter 462 has delegated to the municipalities the responsibility <br /> and authority for carrying on comprehensive land use planning activities , <br /> and for the implementation of said planning activities through the <br /> adoption and enforce�nent of appropriate zoning regulations and ordinances <br /> which promote the public health, safety, morals and general welfare; and <br /> WHEREAS, the City of Orono in response to this responsibility <br /> adopted a Comprehensive Guide �Plan setting iorth the basic goals and <br /> principles to guide development within the City; and <br /> WHEREAS, pursuant to the Comprehensive Guide Plan, the City <br /> Council adopted the Zoning Code of the City of Orono, which code sets <br /> • forth the detailed land use regulations and performance standards for <br /> the use and development of land within tne City; and <br /> WHEREAS, since the adoption of the above Com�rehensive Plan <br /> and Zoning Code, the State Legislature adopted the 1976 Metropolitan <br /> Land Planning Act which does require the City of Orono to review the <br /> previous Comprehensive Plan in relation to new information and current <br /> trends in population growth, transportation, public facilities and <br /> economic development; and . . <br /> � 5 • . <br /> . WHEREAS, the City of Orono has begun the requisite planning <br /> � review with staff and consultants reviewing City-wide issues and also <br /> with the designation of detailed study areas, which are receiving <br /> �• special attention due to special planning problems ; and <br /> '�� <br /> WHEREAS, one of the detailed s�tudy areas is the "Stubbs Bay <br /> Area" shown on attached Exhibits A & B, which area is worthy of special <br /> , study because of the proximity to Lake Minnetonka, a relativeiy large <br /> number of homes located on relatively small lots , the general trend <br /> . toward housing deterioration, the present lack of municipal sanitary <br /> sewer service, poor soil conditions and substandard or potentially <br /> failing septic systems , a newly defined flood hazard designation, and <br /> � the receipt of a proposal to develop the Stubbs Bay Marina property, <br /> the combination of which factors are unique to this area and are not <br /> generally applicable to other areas of the City; and <br />
