Resolution No. ��99 <br /> � Page 44 � <br /> NR 84 General Administration <br /> a . ) Aciministration and Enforcement: "Municipalities shall <br /> provide for the administration and enforcement of the <br /> � Municipal Shoreland Ordinance adopted pursuant to Minnesota <br /> Statutes 1974, Section 462 . 362. " <br /> � 1. Permit System: "In order to facilitate orderly and <br /> efficient administration and enforcement of municipal <br /> shoreland ordinances , municipalities shall establish <br /> permit procedures for building construction, installation <br /> of sewer and water facilities , and grading and filling <br /> in shoreline areas." <br /> 2,' Variances : "Variances shall only be granted when <br /> � there are particular hardships which make strict <br /> enforcement of official controls impractical. They <br /> . shall not circumvent the general purposes and intent <br /> • of the official controls . No variance may be granted <br /> that would allow any use that is prohibited in the <br /> zoning district in which the subject property is located. <br /> Conditions may be imposed in the granting of variances <br /> to insure compliance and to protect adjacent properties <br /> and the public interest. " - <br /> . 3. Nonconforming Uses : "Under authority of Minnesota <br /> � Statutes 1974, .Section 462, municipalities may adopt <br /> provisions to regulate, control and reduce the number <br /> or extent of and gradually eliminate nonconforming and <br /> substandard uses. Municipalities shall provide for the <br /> � � elimination of sanitary facilities inconsistent with <br /> NR83 over a period of .,time not to exceed 5 years from <br /> the date of enactment of the municipal ordinance. " <br /> t, <br /> 4. The Hennepin County Department of Trans�ortation has administrative <br /> authority, including rules and regulations which control access from , <br /> private property onto �oun'ty controlled highways including County Road 84 <br /> abutting the north and east sides of the Marina property. Responsibilities <br /> include maintenance of traffic flow, a dequate design for safe traffic <br /> manuvering, drainage control and proper roadway maintenance. Permits <br /> . are required for all curb cuts (access points) . � <br />
