A' <br />17 a a. <br />Tenant will have the Option to enter into a Purchas <br />Agreement to acquire anytime during the origin rem ANY <br />extension thereof of this lease whereby th ant has the <br />Option to purchase only that part of t emised premise from <br />the Landlord at the then appraise ue of the leased area <br />or for whichever is igher value at the time of <br />sale and appraisal. CONDITIONAL USE/ZONING: This Lease of Property <br />Agreement will become NULL AND VOID unless the Tenant is <br />permitted to locate, construct, place facilities including a <br />building thereon the described premise. Should local <br />planning and zoning boards, and/or other governmental <br />agencies, private parties and/or adjacent property owners <br />deny the Tenant the right to place it's telephony facilities <br />thereon the premises as described, this agreement will be <br />cancelled and no lease payments or improvement funds -•:.11 be <br />diapersed by the.Tenant to the Landlord and/or i•s agents. <br />19. VARIANCES: It is the Tenant's responsibility to file <br />for and support all costs necessary to secure the proper <br />govermental agency approvals to complete the project. <br />However, the Landlord will make every effort to aid, assist <br />and represent, if called upon, at scheduled Zoning/Planning <br />,neetings, Council proceedings and/or Board of Adjustments, <br />for tax purposes, on behalf of the Tenant in order to assist, <br />testify and aid in the completion of the Tenants objective. <br />Page 10 of 10 <br />
