� '( :I i t . C Y RESOLUTION NO. 1080 . A RESOLUTION ORDERING A FEASIBILITY STUDY FOR MINNETONKA BLUFFS - WEST FERNDALE ' SEWAGE TREATMENT PROJECT � WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, for the purpose of protecting the public health and safety and for promoting the most general public welfare, the City has adopted Ordinance No. 210, The On-Site Sewage Treatment Code, which ordinance regulates the proper design, location, construction, alteration, use and maintenance of on-site sewage treatment systems, and which ordinance established a program for inspection of existing on-site systems to assure a minimum, adequate level of sewage treatment in the City; and ' - WHEREAS, this inspection program has identified a definable neighborhood in the City termed �the "Minnetonka Bluffs - West Ferndale Area" including the properties shown on the attached map (Exhibit A) , which has a significant percentage of on-site sewage treatment systems which do not conform to the minimum requirements of Ordinance No. 210, which are not performing an adequate level of sewage treatment, and • for which reconstruction to minimum standards is costly and/or impossible due to unusual topography, steep slopes, poor soil, high water table or small lot size; and WHEREAS, the above described condition is causing pollution of the ground and surface waters and a distinct and direct hazard to the public health and safety requiring remedial efforts by the property owners involved, which effort will most iikely require public coordination by the City in the form of a public improvement project; and WHEREAS, on September 17, 1979, the City Council held an informational meeting to which all the: property owners in the affected neighborhood were_ invited, and at which meeting the existing sewage � treatment problems were discussed together with various options available for correction of the problems; and WHEREAS, a consensus of opinion at this meeting was that there is an undisputed sewage treatment problem in the neighborhood and that , the problems could likely not be solved on individual lots by individual � property owners; and WHEREAS, a further consensus of opinion at this meeting was that a likely alternative solution to the problem is construction of a sewage collector system culminating in a common drainfield or in a connection to the Metropolitan Waste Control Commission Interceptor Sewer running •through the area; and
