From a <br />technical standpoint, please be advised that in addition to <br />Hennepin County Document No. ?P''0'44, to which you refer in your <br />letter, there are two additiona -uments concerning the easement <br />in question. The first is Henr.E ..& County Document No. 3003391, a <br />trustee's deed, the second is Document No. 3003392, a quit claim <br />deed. The t•ustee's deed runs from Northwestern National Bank of <br />Minnesota as trustee of an estate, to Summit Park Development <br />Company, Inc. with a reservation of an easement in favor of the <br />for.ner, while the quitclaim deed grants to Summit Park Development <br />Company an easement over a portion of the property shown on the <br />proposed plat as Outlot C. <br />As counsel for the City of Orono, we were asked to review the <br />proposed plat of the Hauser/Lauer/WCC Addition, upon examining <br />the proposed plat and the documents referred �o above, our initial <br />reaction was that, to ensure good title to an easement to be <br />granted to the City over the north 16--1/2 feet of proposed Outlots <br />B and C, it would be necessary to obtain the consenr of the <br />beneficiaries of the existing easement which was created by the <br />above -described documents, we subsequently reviewed this position <br />with Minnesota Title Company and they agreed that the consents <br />would be necessary. <br />200' 35tid S-IdW A 1 tiH WdHdOd WOd3 80 : r I 63, 6 i:)0 <br />...., .... ... . .... _. � - .-.�� ��....NMY1�r�tw.•.M r+..TM�rr+.�4.. ��. - ���.va�l.�'w.-.Ip �.{.'�•w-+�w...-•+r�. .. _ a-�r•s .. <br />
