City of OR ONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.27, SUBDIVISION 5 (F) <br />FILE #1466 <br />WHEREAS, Dan Rckesh (hereinafter "the applicant") is <br />the owner of the property located at 4040 Watertown Road within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.27, Subdivision 5 <br />(B) to permit the construction of a screen porch addition to be <br />located 25.7' from the front lot line where a 100' front setback <br />is normally required, and 46.8' from the side lot line where a <br />50' side lot line setback is normally required, and for <br />construction of a proposed deck to be constructed 42' from the <br />front lot line and 29' from the side lot line where 100' and 50' <br />setbacks are normally required respectively. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1466. <br />2. The property is located in the RR-lA Single Family <br />Rural Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on October 16, 1989, a..d recommended approval of the <br />proposed variance based upon the following findings: <br />A) The entire existing residence is located less that <br />the required 100' from the front lot line. This house <br />was constructed before the 100' setback requirement was <br />in effect. <br />B) The proposed screen porch addition extends along <br />the existing front line of the house, and is suitably <br />screened from the roadway by existing topography and <br />vegetation conditions. <br />Page 1 of 4 <br />
