City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS I i 2 <br />FILE #1464 <br />WHEREAS, Charles E. Nadler (hereinafter "the <br />applicant") is the owner of the property located at 2509 Kelly <br />Avenue within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Tract B, Registered Land Survey #1428, Files of the <br />Registrar of Titles, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for <br />variances to Municipal Zoning Code Section 10.22, Subdivisions 1 <br />& 2 to permit the construct{on of additions to the existing <br />residence, which additions extend lakeward of the average <br />lakeshore setback line where no encroachment is normally allowed, <br />and which result in hardcover on the property of 29.3% in the 75- <br />250' lakeshore setback zone where only 25% hardcover is normally <br />allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1464. <br />2. The property is located in the LR-1B Single Family <br />Rural Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on October 16, 1989, and recommended approval of the <br />proposed variances based upon t..a following findings: <br />A) The average lakeshore setback variance is necessary <br />because the residence structure to the immediate north <br />of this property is located approximatc__y 250' from the <br />shoreline, with the frontage on an inlet channel but <br />no existing views of the main lake.
