du� <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />r.�•a <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 a 2 <br />FILE #1459 <br />WHEREAS, James A. Mulvanny (hereinafter "the <br />applicant") is the owner of the property located at 559 Park Lane <br />within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Lots 9 and 10, Block 6, Minnetonka Summit Park, Hennepin <br />County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for <br />variances to Municipal Zoning Code Section 10.22, Subdivisions 1 <br />and 2 to permit the construction of a room addition which will <br />result in hardcover on the property in excess of the 25% <br />hardcover normally allowed in the 75-250' zone, and which <br />addition will encroach 8' past the defined average lakeshore <br />setback line where no encroachment is normally allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1459. <br />2. The property is located in the LR-1B Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on September 19, 1989, and recommended approval of the <br />proposed variance based upon the following findings: <br />A) The 8' average lakeshore setback encroachment has <br />no significant impact on lakeviews enjoyed by <br />neighboring property owners. Furthermore, the proposed <br />addition is located approximately 100' from the <br />shoreline. <br />B) Hardcover in the 75-250' zone will decrease by 30 <br />s.f., from 34.76% down to 34.51%, as a result of this <br />proposal. The significant areas of hardcover on the <br />property are generally necessary for functional use of <br />the property. <br />Page 1 of 4 <br />
