Minnesota 5M23 • Municipal Offices <br />On the North <br />Shore <br />8 of Lake <br />8 9 Minnetonka <br />August <br />Bo Hibbs <br />1905 Fagerness Point Road, <br />Wayzata, MN 55391 <br />Re: Proposed Enclosure of Overhang <br />Dear Mr. Hibbs: <br />On Friday, August 4, 1989, Zoning Administrator Jeanne <br />Mabusth and I viewed your property to consider your proposal to <br />enclose the existing overhang area adjacent to your driveway, <br />near Webb Street. <br />In reviewing the site plan of your property, it is apparent <br />that your existing hardcover is approximately 40%, where only 25% <br />is allowed. City policy is that, although the overhang certainly <br />constitutes hardcover, the enclosure of she overhang is a change <br />in the nature of that hardcover which requires variance approval. <br />There is also some question as to whether Webb Street or <br />Fagerness Point Road (or both) should be considered as your front <br />yard given the location of your driveway. This would to some <br />degree affect how much of a setback is required. I note from a <br />1980 variance request that the proposed detached garage (which <br />shows up on the survey but which was never built) was supposed to <br />meet a 30' setback from both streets. <br />I have enclosed a copy of the variance application form for <br />your use. Your completed application should be returned to this <br />office with all submittals no later than noon on Fr. lay, August <br />25th in order to be schedult-- for a September 18th Planning <br />Commission meeting, with the earliest feasible final Council <br />action on October 9th. <br />Please contact me if you have further questions. <br />Sincerely, ` <br />Michael P.
