City policy is that, although the overhang certainly
constitutes hardcover, the enclosure of she overhang is a change
in the nature of that hardcover which requires variance approval.
There is also some question as to whether Webb Street or
Fagerness Point Road (or both) should be considered as your front
yard given the location of your driveway. This would to some
degree affect how much of a setback is required. I note from a
1980 variance request that the proposed detached garage (which
shows up on the survey but which was never built) was supposed to
meet a 30' setback from both streets.
I have enclosed a copy of the variance application form for
your use. Your completed application should be returned to this
office with all submittals no later than noon on Fr. lay, August
25th in order to be schedult-- for a September 18th Planning
Commission meeting, with the earliest feasible final Council
action on October 9th.
Please contact me if you have further questions.
Sincerely, `
Michael P.
