To: Planning Commission Chairman Kelley
Orono Planning Commission Members
City Administrator Bernhardson
From: Michael P. Gaffron, Asst Planning & Zoning Administrator
Date: September 15, 1989
Subject: #1453 William (Bo) Hibbs, 1905 Fagerness Point Road -
Variance - Public Hearing
Zoning District - LR-lC, Single family lakeshore residential,
acre, sewered
Application - Request for hardcover variance to enclose existing
canopy area.
List of Exhibits
Exhibit A - Application
Exhibit B - Plat Map
Exhibit C - Property Owners List
Exhibit D - Survey
Exhibit E - Survey with Staff Revisions
Exhibit F - Applicant's Submitted Hardcover Calculations
Exhibit G - Staff Hardcover Review
Exhibit H - Staff Letter to Applicant dated 8/8/89
Pertinent Facts -
1. This property is located at the intersection of Fagerness
Point Road and Webb Street. As a corner lot abutting a
street and a side street-, the normal required side street
yard setback along Webb Street would be 15' per Section
10.25, Subdivision 6 (B). The applicant proposes to enclose
an existing roof extension of the house, in the area of the
driveway. This enclosure will be 18' from Webb Street,
meeting the required side setback.
2. However, because this is a change in the nature of ixisting
hardcover (similar to enclosing an open porch, for
instance), the existing 45.1% hardcover requires that a
hardcover variance be obtained in order for this applicant
to enclose this canopy area.
3. In reviewing the existing hardcover, there are a few areas
of landscape rock with plastic that could conceivably be
removed to decrease the hardcover percentage. There also is
a concrete sidewalk northeast of the house which could be
eliminated. The bituminous to the immediate southwest of
the proposed enclosure would also seem to be extraneous, but
might also be necessary to maintain drainage away from the
house at that uphill side. Obviously, the majority of this
residence was constructed prior to the effective date of the
hardcover ordinance in 1975.
