The applicant is proposing to <br />enclose an existing canopy area to make it a screened porch. <br />This area is already hardcover, but is a change in the nature of <br />hardcover where hardcover is already at 45.1% in the 75-250' <br />zone. <br />The Planning Commission considered this application at their <br />September 16, 1989 meeting and recommended on a vote of 5-1 to <br />deny the request. The basis for denial was that there is no <br />existing garage on the site, and the current proposal was not <br />comprehensive in nature. Planning Commission was concerned that <br />the applicant or a future owner would likely at some later date <br />request additional variances to construct a garage. <br />Applicant noted that the logical place for a garage would be <br />a tuck -under at the southeast of the house, accessing directly to <br />Fagerness Point Road. Such a scheme has not been proposed by <br />applicant at this time, but a brief look at the property would <br />suggest that such a scheme could reduce bituminous paving on the <br />property by 200-300 square feet or about 3%. Also note that a <br />tuck -under garage exiting to the southeast would require a <br />variance for garage door location being less than 30' from the <br />right-of-way. <br />The minority opinion at the Planning Commission level was <br />that "hardcover is hardcover" and that the applicant is not <br />increasing hardcover, is proposing to enclose to canopy that meets <br />the required setbacks, and any future changes re�iuiring a garage <br />would require another variance application and review by the <br />Planning Commission: regardless of the current request. <br />
