A RESOLUTION GRANTING <br />PRELI14INARY APPROVAL OF THE PROPOSED <br />FOX BEND PLAT <br />FILE NO. 1411 <br />WHEREAS, Nina Wildman of Sussex Sqnare Development <br />(hereinafter "the subdivider") on May 12, 1989 filed a formal <br />subdivision application with the City for approval of an 18 lot <br />residential plat of property legally described as follows: <br />Exhibit A, attached, (hereinafter "the pro,. -.arty") and; <br />WHEREAS, after due published and mailed notice in <br />accordance with Minnesota Stat.,:es 462.358 at. seq. and the City <br />of Orono Zoning and Platting Codes, the Orono Planning commission <br />held public hearings on June 19, 1989 and September 6, 1989 at <br />which times all persons desiring to be heard concerning this <br />application were given the opportunity to speak thereon; and <br />WHEREAS, at their reguiar meeting held on October 9, <br />1989 the Orono City Council considered the subdivision <br />application of Sussex Square Development, noting the following <br />findings of fact: <br />1. The property is located within the RR-lB Single Family <br />Rural Residential Zoning District requiring a minimum of 2.0 <br />acres of contiguous dry buildable land within each newly <br />created lot. <br />2. The subdivision as amended consists of 17 lots each <br />meeting or exceeding the 2 acre minimum d_-y contiguous lot <br />area requirement. <br />3. Each of the 17 lots meets the required lot width to the <br />rear of the 50' front street setback line. <br />4. All of the 17 lots shall achieve access via a network of <br />interior private roadways. <br />5. In his report dated August 30, 1989, Glenn Cook the City <br />Engineer found the revised 17 lot plat to be acceptable and <br />recommended approval subject to the watershed's review. <br />6. On August 22, 1989, Michael P. Gaffron, Assistant <br />Planning and Zoning Administrator, confirmed that all 17 <br />lots had been tested and found to have suitable areas for <br />on -site development. <br />Page 1 of 5 <br />
