A RESOLUTION GRANTING <br />AN AFTER -THE -FA "P VARIANCE TO <br />MUNICIPAL ZC ING CODE <br />SECTION 10.22, SUBDIVISIONS 1 a 2 AND <br />SECTION 10.55, SUBDIVISION 8 AND <br />A CONDITIONAL USE PERMIT PER <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #1439 <br />WHEREAS, Lawrence Langhans (hereinafter "the <br />applicant") is the owner of the property located at 1366 Rest <br />Point Road within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />Lot 2, Block 1, Rest Point, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has made application to the City <br />of Orono for after -the -fact approval of variances to Municipal <br />Zoning Code Section 10.22, Su, divisions 1 and 2, and Section <br />10.55, Subdivision 8, and a conditional. use permit per Section <br />10.03, Subdivision 19, for the construction of retaining walls in <br />the 0-75' lakeshore setback zone where no structure or hardcover <br />is normally allowed, and fu-ther for the construction of a deck <br />located 10' from the lakeshore where no such structure is <br />normally allowed. <br />NOW, THEREFORa, S r IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1439. <br />2. The property is located in the LR-lB Single Family <br />Lakeshore Res.3ential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on August 21, 1989, and recommended on a vote of 5-0, <br />partial approval of the proposed after -the -fact variance and <br />conditional use permit, making the following findings and <br />recommendations: <br />Page 1 of 6 <br />
