1�llf�� � lf1 d Tk <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE #1454 <br />WHEREAS, Bradford W. Reddick (hereinafter "the applicant") <br />is the owner of the property located at 2695 Pheasant Road within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lot 8, Block 1, Pheasant Lawn, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.24, Subdivision 5 <br />(B) to permit the construction of a detached garage to be located <br />9.1' from the side lot line where a 10.0' side yard setback is <br />normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1454. <br />2. The property is located in the LR-lB Single Family <br />Lakeshore P.eGiOprclal Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on September 18, 1989, and recommended approval of the <br />proposed variance based upon the following findings: <br />A) The existing house is not square with the lot, <br />which forces the garage addition to extend closer to <br />the lot line than the existing house. <br />B) Granting the proposed variance will not cause <br />excessive visual density in the neighborhood. The <br />neighboring adjacent residence is located more than <br />2C' from the lot line, hence a suitable structure -to - <br />structure setback will be maintained. <br />C) The existing access door adjacent to the garage <br />would have to be eliminated if the 22' wide garage was <br />moved further northward to meet the side setback <br />requirement. <br />Page 1 of 4 <br />
