C) The existing drainage patte-, of the property <br />provides for positive drainage .o the lake over <br />extensive grassed yard areas. <br />D) The proposed improvement of the property will not <br />result in an increase in total hardcover. <br />E) The current residence does not have a garage nor a <br />basement area to provide additional storage area. <br />F) The proposed street setback for the attached garage <br />will prevent the cutting into the existing root system <br />of a group of trees well over 100 years old located in <br />the east yard area. <br />4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by Cite staff, comments by the <br />applicants and the effect of the proposed variances on the <br />health, safety and welfare of ..a community. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variances would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicants; and would be in keeping ;with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one L. more of the findings noted above, the <br />Orono City Council hereby grants variances to Municipal zoning <br />Code Section 10.22, Subdivision 2 and Section 10.24, Subdivision <br />5 (B) that would F armit the construction of an atti ched garage <br />based on the simultaneous removal of existing nonstructural <br />hardcover on the property as noted above, subject to the <br />following conditions: <br />1. Applicants shall remove all hardcover, as proposed in <br />amended plan (Exhibit K) at the time of the footing <br />inspection for the proposed garage addition. <br />Page 2 c.z 4 <br />
