A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 i ' AND <br />SECTION 10.55, SUBDIVISION 8, AND <br />GRANTING A CONDITIONAL USE PERMIT PER <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #1446 <br />WHEREAS, Jack Yost (hereinafter "the applicant") is the <br />owner of the property located at 1515 Green Trees Road within the <br />City of Orono (hereinafter "City") and legally described as Lot <br />3, Block 1, Green Trees, Hennepin County, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, the applicant has made application to the City <br />of Orono per Section 10.22, Subdivisions 1 and 2 and Sect'_on <br />10.55, Subdivision 8 and Section 10.03, Subdivision 13 to permit <br />certain grading and filling activities and the insi-&llation of <br />retaining walls within the 0-75' lakeshore setback area vnere nr- <br />such activities or structures are allowed resulting in 1,361 <br />square feet or. 4% of hardcover where 800 square feet or 2.4% <br />exists today. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1446. <br />2. The property is located in the LR-lA Single Family <br />Lakeshore Residential Zoning District requiring 2 acres in <br />area. <br />3. The property is approximately 2+ acres in area. <br />4. The Orono Planning Commission reviewed this application <br />on September 6, 1989 and recommended approval of the <br />proposed variiLnces and conditional use permit as proposed, <br />based on the following findings: <br />A) The existing retaining walls within the lakeshore <br />yard are in a serious state of deterioration and <br />present a hazard to persons who use the yard area. <br />Page 1 of 5 <br />
