Mabusth, Building & Zoning Administrator DATE: August 30, 1989 SUBJECT: #1446 ML. and Mrs. Jack Yost, 1515 Green Trees Road - Conditional Use Permit/Variance - Public Hearing Pertinent Ordinances - Section 10.22 Subd. 1 and 2. Section 10.55 Subd. 8 Application involves replacement of retaining walls and land alterations within 75 feet of the lake. Section 10.03 Subd. 19. The application also involves land alterations in excess of 100 cubic yards outside of the 75 foot setback area. The building permit for the lakeside addition noted on survey, Exhibit F is certified by surveyor at 76 ft. In review of Exhibit G a survey done by the same survey firm but another surveyor confirms that there was only 75 ft from the corner of the existing house, placing the new addition 65 ft from the lake. Note applicants consultant has used the correct base survey for enclosed exhibits. The 75 ft setback mark as shown on all plans is based on the 929.4 elevation. It is not known the exact date the retaining walls were constructed in the lakeshore yard. Some of the wall sections may have existed when the former residence was constructed. Newer sections were constructed without the benefit of a land use or building permit review.
