15 <br />City of � 1 <br />36 <br />���� <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1386 <br />A RESOLUTION APPROVING A SETBACK VARIANCE <br />FOR THE FIRST NATIONAL BANK OF NAVARRE FOR <br />A PROPERTY LOCATED AT 2445 SHADYWOOD ROAD <br />WHEREAS, the City of Orono is a municipal corporation organized <br />under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statute 412 et. seq. and 462 et. seq. <br />the City Council of the City of Orono has adopted zoning regulations <br />for the protection of the public health, safety and general welfare; and <br />WHEREAS, pursuant to Ordinances 32.300 and 35.356 David J. <br />Delaney, president of the First National Bank of Navarre, has applied <br />for a side yard setback variance to permit construction of an overhead <br />canopy structure that will extend to within 3.5' of *he south property <br />line on a property legally described as: <br />That part of Lots 1 and 2, Block 4, Townsite r° Langdon <br />Park, described as follows: Commencing at a pint on <br />the Northeasterly line of said Lot 2, a distance of <br />328.17 feet Southeasterly from the Northeast corner of <br />said Lot 1; thence Southwesterly along a '_ine a distance <br />of 16.54 feet to the Southwesterly right-of-way line of <br />County Road No. 19, which point is the actual point of <br />beginning of the land to be described (said above <br />Southwesterly line is described as follows: Commencing <br />at a point on the Northeasterly line of said Lot 2 a <br />distance of 328.17 feet Southeasterly from the Northeast <br />corner of said Lot 1; thence Southwesterly a distance <br />of 300 feet to a point distant 242.87 feet Southeasterly <br />of a point 100.0 feet East from a point on the West ine <br />of said Lot 1 distant 234.0 feet South from rthwest <br />corner of said Lot 1); thence continue South <br />along the above -described line a distance of let; <br />to a judicial landmark; the-:e Northwesterly a :e <br />of 100.0 feet to a judicial landmark; thence No. erly <br />a distance of 250.0 feet to a judicial lan,imart <br />Southwesterly right-of-way line of County Roau No <br />thence Southeasterly along said right-of-way line <br />distance of 100.0 feet to the point of beginning. <br />WHEREAS, the City Council has reviewed the application; the <br />recommendations of staff and the Planning Commission and letters and <br />comments by the applicant. <br />Page 1 of 5 <br />
