The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, conunents by the applicant <br />and the effect of the proposed variance on the health, <br />,z,fety and welfare of the community. <br />71,e City Council finds that the conditions existing on <br />th's G>roperty are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor posy. a fire hazard or other danger to <br />neighboring propeity; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be -n keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER FIND CONDITIONS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants a variance: to Municipal Zoning <br />Code Section 10.03, Subdivision 9 (D) to permit the construction <br />of a pool and pool house to be placed 35' in front of the front <br />line of the existing residence that fronts on Fox Street, subject <br />to the following conditions: <br />1. A 10' separation must be maintained between proposed <br />pool house and swimming pool. <br />2. Applicant to amend land. ---Aping plan by Dundee Nursery <br />and Landscape Company date- June 10, 1989 to include <br />additional plantings to the south of the pool house in order <br />to lessen impact of two-story structure. <br />Page 2 of 4 <br />
